These terms are an agreement between you and Khoi Le, a sole proprietor based in California, United States ("Comps", "we", "us"), about using the Comps app. By downloading or using Comps you agree to them and to our Privacy Policy. If you don't agree, please don't use the app.

1. What Comps is

Comps identifies an item from a photo you take and shows what it's currently listed or selling for, using listings and prices from other services, with the listings behind each number so you can check them yourself. Comps is offered in the United States and Canada.

2. Prices are estimates, not appraisals

This is the most important thing in these terms, so it comes first.

• Every price in Comps is an estimate. It comes from current listings, recent sales and store prices published by other services, and those change all the time. What an item actually sells for can be higher or lower, sometimes much higher or lower.
• Listing prices are asking prices, not what an item sold for. Only prices labelled as sales are sales.
• Identification can be wrong. Comps uses automated tools, including AI, to recognise items. It can mistake one version, size, colour or printing for another. When we're not confident we try to say so, but we can be confidently wrong. Check the listings behind a price before you rely on it.
• Comps doesn't authenticate items. It can't tell a genuine item from a fake.
• Comps isn't financial, investment or appraisal advice. Decisions to buy, sell or insure are yours.

3. Who can use Comps

You must be at least 13 years old. If you're under 18 (or the age of majority where you live), you need a parent's or guardian's permission, and they must agree to these terms and make any purchase.

4. Subscriptions, the free trial and limits

• One free scan. You can try one scan before choosing a plan. After that, scanning needs a subscription.
• Two plans:
  • Weekly: $6.99 a week. No free trial.
  • Yearly: $44.99 a year, with a 7-day free trial.
  Prices are in US dollars; the App Store shows the price in your local currency before you buy.
• The free trial comes with the yearly plan only, once per Apple ID. During the trial you can scan up to 10 items a day. If you don't cancel at least 24 hours before the trial ends, you're charged for the yearly plan and your subscription starts. If notifications are on, we remind you 2 days before the trial ends. Any unused part of a free trial ends when you buy a subscription, where Apple's rules apply that.
• Fair use on paid plans. Paid plans have a fair-use limit of 150 scans a day. We may also slow or stop use that looks automated or abusive, such as a script sending scans.
• Billing is through Apple. Payment is charged to your Apple ID when you confirm the purchase (or when the trial ends). Subscriptions renew automatically for the same period and price unless you turn off auto-renew at least 24 hours before the current period ends; your Apple ID is charged for the renewal within the 24 hours before the period ends.
• Cancel or change plans in your iPhone's Settings → your name → Subscriptions, or from Comps' settings, which open the same Apple page. Cancelling stops the next renewal; you keep access until the end of the period you've paid for.
• Deleting the app or your Comps account does not cancel your subscription. It belongs to your Apple ID.
• Refunds are decided by Apple, under Apple's policies (reportaproblem.apple.com). We can't issue refunds and don't promise one.
• Price changes follow Apple's rules, which tell you in advance and, where required, ask you to agree.

5. Your photos and what you type

• You own your photos. You give us permission to process each photo you scan (shrink it, remove its hidden details, and send it to the services that identify and price it, an AI service provider and an online marketplace, as the Privacy Policy describes) only to give you the result. Our server doesn't keep your photo.
• Only photograph things you're allowed to. Don't scan people, other people's private information or documents, or anything illegal.
• Your answers to "Was this right?" and which results you tap may be used to improve Comps.

6. Using Comps fairly

Don't:

• copy, scrape, resell or republish the prices, listings or other data Comps shows, or use Comps to build a price database or a competing service;
• use bots, scripts or anything automated to scan, or to access Comps' servers or the services behind them other than through the app;
• get around limits, the paywall or security, or reverse engineer the app, except where the law allows;
• share one subscription so several people can use it, beyond what Apple's Family Sharing allows;
• use Comps in a way that breaks the law or the terms of the services it shows (section 7).

7. eBay listings

Many listings, photos and prices in Comps come from eBay, through eBay's developer program. eBay requires us to tell you, and by using Comps you agree, that:

1. You are bound by the eBay API License Agreement (developer.ebay.com/join/api-license-agreement) as it applies to users of apps built on eBay's APIs.
2. eBay is a third-party beneficiary of these terms, and may enforce them directly against you.
3. Your right to see eBay content in Comps is a sublicence (personal, non-exclusive and non-transferable) that we or eBay can revoke at any time.
4. You may use eBay content only by viewing it in the app. You have no programmatic access to eBay through Comps.

Also:

• eBay content is shown as eBay provides it. A listing in Comps may be behind the same listing on eBay; in your History, listings older than 6 hours show their age, and prices based on eBay listings are hidden once they're more than 24 hours old.
• Buying on eBay is between you and the seller, under eBay's User Agreement. Comps isn't a party to it.
• Comps may earn a commission on eBay purchases made through its links, through the eBay Partner Network. It doesn't change the price you pay.

8. Other services and links

Comps also shows information from other sources (for example store prices from Google Shopping results, sneaker resale data from StockX, and price guides such as PriceCharting) and links to eBay and store websites. We don't control them and aren't responsible for their content, prices, availability or practices; their own terms apply when you visit them. Comps isn't affiliated with or endorsed by eBay, StockX, PriceCharting, Google, OpenAI or any brand or store shown in the app. Their names and marks belong to them.

9. Your account

An account is optional. If you make one, keep your sign-in secure; you're responsible for what happens with it. You can delete it at any time in the app (Profile → "•••" → Delete account); the Privacy Policy says what that deletes. We may suspend or close an account, or stop providing Comps to you, if you break these terms or put the service or others at risk.

10. What's ours

The Comps app, its design, its name and its content belong to us. You may use the app under these terms, but you may not copy, resell or redistribute it.

11. No warranty

Comps is provided "as is" and "as available". To the fullest extent the law allows, we make no promises that it will be accurate, complete, uninterrupted or error-free, or that a price, identification or listing is correct or current. Comps depends on outside services, and those services can change or go down. Some places don't allow these exclusions, so some may not apply to you.

12. Limit of liability

To the fullest extent the law allows, Comps and the companies that provide its data (including eBay) are not liable for any indirect, incidental, special or consequential loss, including a profit you didn't make or money lost on a purchase or sale, arising from your use of Comps. Our total liability for any claim is limited to the amount you paid for Comps in the 12 months before the claim. Nothing here limits liability that the law doesn't allow us to limit.

13. Changes to Comps and to these terms

We may change, add or remove features, sources or categories at any time. We may update these terms; we'll post the new version here with a new date and, for a significant change, tell you in the app. Continuing to use Comps after a change means you accept the updated terms.

14. Law

These terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules. If you live in Canada or elsewhere, nothing in these terms takes away rights that your local consumer protection law gives you and that can't be waived by contract. If you have a problem, please write to [email protected] first; most things can be fixed that way.

15. The rest

If part of these terms can't be enforced, the rest still applies. If we don't enforce a term right away, we haven't given it up. You can't transfer these terms; we can, if Comps is sold or merged. These terms, with the Privacy Policy, are the whole agreement between you and us about Comps.

16. Apple

These terms are between you and Comps, not Apple. In addition:

1. Apple isn't responsible for Comps or its content. We are.
2. Your licence is a non-transferable licence to use Comps on Apple devices you own or control, as the App Store's Usage Rules allow (including Family Sharing).
3. Support is ours to provide, not Apple's: [email protected]. Apple has no obligation to provide maintenance or support for Comps.
4. Warranty: if Comps fails to meet any warranty that applies by law, you may tell Apple, and Apple will refund the purchase price of the app (if any). Apple has no other warranty obligation for Comps; any other claim is ours to handle.
5. Claims about Comps (product liability, failure to meet a legal or regulatory requirement, or consumer protection, privacy or similar laws) are ours to handle, not Apple's.
6. Intellectual property: if someone claims Comps infringes their rights, we, not Apple, are responsible for investigating and resolving it.
7. You confirm that you're not in a country under a US Government embargo or designated as "terrorist supporting", and that you're not on a US Government list of prohibited or restricted parties.

9. Third-party terms: you must follow any third-party terms that apply when you use Comps (for example your mobile carrier's, and eBay's in section 7).
10. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
